Simple electronic signature (SES)
signhere creates a simple electronic signature (Art. 3(10) eIDAS Regulation (EU) No 910/2014). Under Art. 25(1) eIDAS it must not be denied legal effect solely because it is electronic, but it is subject to free judicial assessment. signhere is not a qualified trust service provider and does not create advanced or qualified signatures.
When a simple signature is not enough
Germany: where the law requires written form (section 126 BGB), only a qualified electronic signature (QES) replaces the handwritten one (section 126a BGB). Terminating an employment relationship (section 623 BGB) and giving a guarantee (section 766 sentence 2 BGB) exclude electronic form altogether. Austria: a QES meets the requirement of a handwritten signature (section 4 Signature and Trust Services Act), with exceptions such as wills and consumer guarantees. Switzerland: only a qualified signature under ZertES with a qualified time stamp is equivalent (Art. 14(2bis) Code of Obligations); a QES under EU law is not automatically recognised there. When in doubt, check which form your document requires.
